ACCEPTANCE
The seller is defined below as Mrs. Laurie Berck (Meublezon), whose registered office is located at 1 Place de l'Étape, 45000 Orléans, France, registered with the Orléans Trade and Companies Register under number B 535 243 034 RCS
The buyer is defined below as the company or person signing and accepting these terms of sale.
These general terms and conditions of sale apply exclusively to all sales concluded by Meublezon.
Any other conditions are binding on the seller only after written confirmation from them.
The information provided regarding products and services is for informational purposes only and may be modified by the seller without prior notice.
Placing an order or accepting an offer from the seller constitutes unreserved acceptance of these terms and conditions.
These terms and conditions of sale may be modified at any time and without prior notice by Ms. Laurie Berck, and such modifications will apply to all subsequent orders.
PRICES
Unless otherwise stipulated in the contract, our offers and price lists correspond to the rates in effect at the time the catalogue was designed and do not bind us beyond that.
The prices shown on the website are in Euros (including all taxes), excluding shipping and handling.
They are subject to change without notice. In the event of a significant price increase between the date of your order and the date of the invoice, or in the event of a pricing error, we reserve the right to request payment of the difference, or, if necessary, cancel the order. Your payment will, of course, be refunded.
Unless otherwise agreed upon by a credit institution and Madame Laurie Berck, the price is payable in full and in a single payment upon ordering.
All orders are invoiced and payable in Euros only, except under special conditions.
For any delivery outside Metropolitan France, any customs duties or local taxes remain the responsibility of the customer.
CLAIMS
All claims relating to a defect in the goods delivered, an inaccuracy in the quantities or their incorrect reference in relation to the accepted offer or the order confirmation by the seller, must be made to the seller by registered mail within 72 hours of receipt of the goods.
Return Agreement:
All returns require the prior agreement of Ms. Laurie Berck.
Without a return agreement, the merchandise will be returned to you or held at your disposal, at your expense, risk, and peril, with all transport, storage, and handling costs being your responsibility. Products are returned at your expense and risk.
We therefore advise you to declare the value of the merchandise and to take out transport insurance.
PAYMENT
All orders are payable online using the methods offered. Ms. Laurie Berck reserves the right to request a bank check if the amounts involved are significant.
Supporting Documents:
To prevent fraud, Ms. Laurie Berck reserves the right to request proof of identity, address, and payment method before accepting the sale. In this case, your order will be processed upon receipt of these documents.
We reserve the right to cancel your order if we do not receive these documents or if the documents received are deemed non-compliant.
RETENTION OF TITLE
The goods delivered and invoiced to you will remain the property of Ms. Laurie Berck until full payment of the price.
Failure to pay may result in the repossession of the goods, with immediate return at your expense, risk, and peril.
During the period between delivery and transfer of ownership, the risks of loss, theft, or destruction, as well as any damage you may cause, remain your responsibility.
RIGHT OF WITHDRAWAL RESERVED FOR PRIVATE INDIVIDUALS
No right of withdrawal for perishable goods:
In accordance with the provisions of Article L. 221-28 4° of the French Consumer Code, perishable food products cannot be returned or are liable to deteriorate or expire rapidly. Consequently, there is no right of withdrawal and no perishable product may be returned or exchanged.
Right of withdrawal for non-perishable products:
In accordance with Article L. 221-18 of the Consumer Code, the Customer has a period of fourteen (14) calendar days from the date of order confirmation to exercise his right of withdrawal, without having to justify his reason or bear any penalties.
The right of withdrawal may be exercised by sending an unambiguous statement expressing the intention to withdraw.
The Seller will send an acknowledgement of receipt of the exercise of this right.
If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs will be refunded, the return costs remaining the responsibility of the Customer.
The refund will be made within a maximum of 30 days from the receipt, by Mrs. Laurie Berck, of the Products returned by the Customer under the conditions provided for in this article, using the same payment method as for the purchase.
REFUND CONDITIONS
For all refunds, and except as specified in Article 8, Ms. Laurie Berck will only issue a credit note for an amount equal to the value of the item(s) to be refunded. This credit note will be valid for one year, unless otherwise stated on the credit note itself.
It can be used for all products and services offered by Ms. Laurie Berck.
This refund service is valid for any product other than perishable goods and services within 7 days of purchase, provided that it is returned new, in its original packaging.
DISPUTE RESOLUTION
In the event of any dispute that may arise between the two parties concerning the validity, interpretation or performance of this contract, and failing an amicable agreement, the courts of Orléans shall have sole jurisdiction by express agreement, even in the case of incidental claims, third-party claims or in the case of multiple defendants.
